And if reporters are 'allowed' to protect their sources, then we should be clear about what we mean by 'allowed'. Miller argued in court that her refusal to testify is an example of civil disobediance where she must follow her conscience. That is not an argument against her being jailed. An essential component of civil disobediance is the willingness to accept the consequences of that disobediance. That's part of what makes it effective. Additionally, one's duty to one's conscience and one's duty to society in respecting the rule of law are both valid and both can be satisified by engaging in civil disobediance but accepting the legal consequences."
